ETG Talent provides recruitment, candidate sourcing, talent placement, employer branding, recruitment marketing, recruitment consulting, and workforce growth solutions (collectively, the “Services”). Our platform connects job candidates seeking career opportunities with employers seeking talent.

2. Acceptance of Terms

By accessing or using any part of our website or Services, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), possess the legal authority to enter into agreements, and agree to comply with all applicable local, state, national, and international laws and regulations.

3. User Roles and Account Responsibilities

3.1 Candidate Users

Candidates accessing ETG Talent to search or apply for job opportunities agree to:

• Provide accurate, current, and truthful information regarding employment history, education, skills, certifications, and contact details.
• Refrain from submitting fraudulent, misleading, or deceptive resumes or applications.
• Acknowledge that submitting an application or resume does not guarantee job placement or an offer of employment.

3.2 Employer Users

Employers engaging ETG Talent for recruiting, employer branding, or workforce consulting agree to:

• Provide accurate company descriptions, job requirements, salary ranges, and working conditions.
• Comply with all federal, state, and local equal employment opportunity (EEO) laws and non-discrimination regulations.
• Execute a separate Master Services Agreement (MSA) or Statement of Work (SOW) where specific fee structures, guarantees, and service scopes apply.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited actions:

• Using the website or Services for any unlawful purpose or in violation of any applicable regulations.
• Attempting to probe, scan, or test the vulnerability of our systems, networks, or databases.
• Submitting or transmitting malicious code, viruses, spyware, or harmful software.
• Scraping, harvesting, or extracting candidate or employer data without prior written authorization.
• Impersonating any individual, entity, or ETG Talent representative.

5. Intellectual Property Rights

All content, branding, logos, graphics, recruitment marketing materials, software, website design, and consulting documentation provided by ETG Talent are the exclusive property of ETG Talent or its licensors. You may not copy, reproduce, distribute, modify, or create derivative works without explicit written permission from ETG Talent.

6. Candidate Submissions & Confidentiality

By submitting your resume or personal information to ETG Talent, you grant us a non-exclusive, royalty-free license to store, review, evaluate, and share your profile with prospective employer partners strictly for placement and career opportunity evaluation purposes, as outlined in our Privacy Policy.

7. Fee Structures and Master Agreements

Specific recruitment, placement, consulting, and branding fees for employers are governed by formal client service contracts executed directly between ETG Talent and the employer client. In the event of any conflict between these general Terms and a signed client contract, the signed client contract shall prevail.

8. Disclaimer of Warranties

THE SERVICES AND WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ETG TALENT DOES NOT GUARANTEE SPECIFIC HIRING OUTCOMES, CANDIDATE RETENTION, OR EMPLOYMENT OFFERS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETG TALENT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless ETG Talent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, misrepresentation of information, or violation of applicable laws.
